Terms of Service

1. Acceptance of Terms

By creating an account or using the Yontari service (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Service Description

Yontari is a web-based platform that uses AI models (currently Rodin Gen 2) to generate 3D models from images and text prompts. The Service is provided on a subscription and credit basis. Credits are debited per generation based on the selected quality tier (Standard, Pro, Ultra). Subscription credits do not roll over to the next billing period. Credits purchased separately (top-up packs) do not expire and carry forward indefinitely.

The Service is provided “as is” and we make no guarantees about output quality, model accuracy, or fitness for a particular purpose. AI-generated 3D model quality varies based on input quality and model complexity.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account, including unauthorised access caused by your failure to keep credentials secure.
• Providing accurate and current account information.
• Promptly notifying us at [email protected] of any unauthorised use of your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

4. Intellectual Property

4.1 Your inputs and outputs

You retain full ownership of the images and prompts you upload (“Inputs”) and the 3D models generated from them (“Outputs”). You may use the Outputs for any personal or commercial purpose, subject to applicable law and the restrictions in these Terms.

4.2 Licence to operate the service

By uploading Inputs, you grant Yontari a limited, non-exclusive, worldwide, royalty-free licence to process your Inputs solely for the purpose of generating your Outputs and providing the Service. This licence terminates when you delete the relevant generation or your account.

4.3 Yontari IP

All software, design, trademarks, and platform infrastructure underlying the Service are owned by or licensed to Yontari. These Terms do not grant you any right to use our trademarks or reproduce our platform.

5. Prohibited Uses

You may not use the Service to:

• Upload images or generate content that is illegal, defamatory, harassing, obscene, or that infringes third-party intellectual property rights.
• Generate 3D models of real people without their consent, or generate CSAM (child sexual abuse material) under any circumstances.
• Attempt to reverse-engineer, scrape, or abuse the platform or its API.
• Use automated tools to create accounts, generate bulk outputs, or circumvent rate limits without written permission.
• Resell API access or generation capacity to third parties without prior written agreement.
• Use the Service in any way that violates applicable laws or regulations.

We reserve the right to suspend or terminate any account found to be in violation of these prohibitions, without refund.

6. Billing and Refunds

Subscription fees are billed monthly in advance via Stripe. Credits purchased separately are non-expiring and non-refundable except as required by law. If a generation fails due to a Service error (not an input quality issue), the credits consumed will be refunded to your account automatically.

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No pro-rated refunds are issued for unused subscription time.

7. Termination

You may delete your account at any time from the account settings page. We may suspend or terminate your access to the Service at our discretion if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your data will be handled in accordance with our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL MEET YOUR REQUIREMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YONTARI'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, or, where arbitration is not available, in the state or federal courts located in Delaware.

11. Changes to These Terms

We may update these Terms from time to time. Significant changes will be notified via email or an in-app notice at least 14 days before taking effect. Continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms.
